Meh.
Today I *almost* got a 4th amendment suppression motion granted on our only trial case that remained. The judge has reserved ruling pending some further research. (It's actually a very interesting issue, which I will surely fail to elucidate here, on the blog, later on, as I will be on to something else by whatever time it is I could revisit the issue and say something cogent about it.)
Yep, that's almost a parseable sentence. I blame the low-grade fever, for which in turn I blame the flu, which I have had for several days now. It started up on Friday, left me prostrate on Sat., settled into a uneasy truce involving slow walking and moderate thinking on Sun., and is now just aches, pains, dull legal arguments, and the occasional discharge, courtesy the various mucosae.
I will fortify myself with the several days stale cake left in the break room and my homemade chicken soup while I attempt to figure out what the muse of Westlaw has for me re: our motion. I know the answer, I just need to build the skeleton of caselaw and then animate it. Right now it's short a leg.
I'm down to one trial partner for the week and he's got walking pneumonia. The judge was very sweet - she asked if we could just go to our chief and tell him we needed to be sick for awhile. Truly though, if there's any way we can make it in we really have to. It's not like they'll let our guys out on a promise to return when we feel better.
